Maryland Mandated Classification Transfer Notification


This announcement is to advise that all 1099 Certified Nursing Assistants, Caregivers, and Personal Care Associates will be re-classified from Independent Contractors to W-2 employees. This classification change is a requirement of the State of Maryland for all home health care workers and agencies.

As a W-2 employee,

  • You would no longer be responsible for calculating your own taxes. Federal, state, and FICA taxes will now be calculated for you and deducted from your paycheck.
  • Based on specific federal and state laws/guidelines and contingent upon your hours worked, you may be eligible for health insurance and selected benefits.

Please remain mindful that this re-classification is state mandated for all CNA's, Caregivers and PCA's (Personal Care Associates) who are working for home health care agencies and Residential Services Agencies.
